Privacy Policy

Privacy Policy – Effective date: May 22, 2012

YES is committed to protecting the privacy of your personal information at all times. This Privacy Policy describes how YES treats personal information it collects and receives from you through YES websites. Personal information includes information such as your name, date of birth, address, e-mail address, telephone, driver’s license, account and Social Security numbers, and financial information such as credit card numbers or Automated Clearing House (“ACH”) personal bank information, that is not otherwise publicly available. We maintain security standards and procedures designed to protect your account and personal information and we will continue to test and update our technology to improve the protection of your information. This Privacy Policy does not apply to the practices of companies that YES does not own or control, or to people who YES does not employ or manage unless otherwise specified within this policy.

  • Security and Integrity :

YES has taken steps to ensure the security of all personal information we collect on YES websites. YES has taken proactive measures to protect against the loss, misuse, and alteration of the information under our control. YES employs encryption technology, protecting data at each point of transfer. To ensure that your credit card, ACH personal bank information, and personal information is even more secure, once we receive your credit card information, we store it on a server that isn’t accessible from the Internet. However, in the unlikely event that you are subject to fraudulent charges, remember to immediately notify your credit card provider in accordance with its reporting rules and procedures and the Credit Reporting Agencies (Equifax, Experian and TransUnion).

At YES, we utilize redundant systems (i.e., backup systems) to reduce the chance of data loss. YES also uses computer virus detection and eradication software on systems containing computer data. Firewalls are also employed to prevent unauthorized computer entry into systems containing your personal information.

  • Information Collection and Use :

When you make payments online on YES websites, we need to know your billing address, e-mail address, apartment complex (or mobile home community, condominium, etc.), account number, phone number, credit card number and credit card expiration data. This allows us to process your payment and credit your account. Credit card transactions may be handled by a third-party financial institution, or a company affiliated with YES which receives credit card numbers, ACH bank information, and other personal identifying information only to verify the credit card and account numbers and process transactions.

YES limits access to personal information about you to YES employees and agents who YES believe reasonably need that information to provide products or services to you or to do their jobs. These individuals are bound by confidentiality obligations and may be subject to discipline, including termination and criminal prosecution, if they fail to meet these obligations.

  • Information Sharing and Disclosure :

YES may provide your personal information to affiliated companies, such as subsidiaries or other commonly-owned companies, or other trusted businesses or persons who work on behalf of or with YES. It is required that these entities/persons sign a confidentiality agreement and operate in compliance with this Privacy Policy. These companies may use your personal information to administer utility services or communicate with you about other information relevant to those services. We do not, however, share your personal information with outside companies for the purpose of selling their products and services to you.

YES may provide information about you in response to subpoenas, court orders or legal process, or to establish or exercise our legal rights or defend against legal claims. YES also may provide information about you if YES believes it is necessary to share information in order to investigate, prevent or take action regarding illegal activities, suspected fraud, situations involving potential threats to the physical safety of any person, or as otherwise required by law.

If YES becomes involved in a merger, acquisition, or any form of sale which will result in the transfer of your personal information to a non-affiliated company, YES will ensure the confidentiality of personal information involved in such transaction by requiring the non-affiliated company to adhere to this Privacy Policy and to provide notice before your personal information becomes subject to a different privacy policy.

YES will not use or share the personal information provided to us through this website in ways unrelated to those described above without providing you with notice and an opportunity to opt-out of such unrelated uses.
